State of Tennessee, without regard to any conflict of law provisions.
Any dispute arising under this Agreement shall be resolved exclusively
by the state and/or federal courts of the State of tennessee, County
of Robertson. The waiver of any provision of these Terms of Use shall
not be considered a waiver of any other provision or of American Motorcycle’
right to later require strict observance of each of the terms herein.
If any provision of these Terms of Use is found to be unenforceable
or invalid for any reason, that provision shall be severable and all
other provisions shall remain in full force and effect. This constitutes
the entire agreement between us relating to your use of the Site and
shall not be modified except in a writing signed by both parties.
TERMINATION
These terms are effective unless and until terminated by either you
or American Motorcycle. You may terminate this Agreement at any time.
American Motorcycle also may terminate this Agreement at any time
and may do so immediately without notice, and accordingly deny you
access to the Site, if in American Motorcycle’ sole discretion
you fail to comply with any term or provision of this Agreement. Upon
any termination of the Agreement by either you or American Motorcycle,
you must immediately discontinue use of this Site and promptly destroy
all materials downloaded or otherwise obtained from this Site, as
well as all copies of such materials, whether made under the terms
of use or otherwise. Note that certain provisions of this Agreement
(Site Contents; User Comments, Materials, Feedback, and Postcards;
Disclaimer; and Indemnity) will survive termination.
INFORMATION WE COLLECT
We do not share information about you with other companies. We automatically
collect your IP address, but not your email address, when you visit
our site. We use your IP address to help diagnose problems with our
server, and to administer our Web site.
We collect your contact information (like email address) and financial
information (like credit card numbers). Contact information from the
order form is used to send orders and information about our company
to you. Financial information that is collected is used to bill you
for products and services.
HOW WE USE YOUR INFORMATION
We use your mailing address to ship your products to you, and to verify
